These Terms of Service ("Terms") govern your access to and use of webspecia.in and related subdomains and tools (the "Site"), operated by Cognidom Technologies Private Limited (CIN: U62011DL2026PTC461109), doing business as Webspecia® ("Webspecia", "we", "us", or "our").

1. Acceptance of Terms

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.

3. Description of the Site

The Site is an informational and lead-generation website for Webspecia's performance marketing, CRM automation, website development, and related digital services. Content on the Site — including service descriptions, case studies, and pricing indications — is provided for general information purposes and does not by itself constitute a binding offer or contract. Nothing on the Site should be relied upon as professional, legal, financial, or medical advice.

4. Eligibility

The Site is intended for business audiences and individuals who are at least 18 years old and legally capable of entering into binding contracts. By using the Site, you represent that you meet these requirements.

5. Acceptable Use

When using the Site, you agree that you will not:

• Attempt to gain unauthorized access to any part of the Site, our administrative systems, or any account, including by probing, scanning, or attempting to bypass authentication or rate limits;
• Interfere with or disrupt the Site's operation, servers, or networks, including through excessive automated requests, denial-of-service attempts, or brute-force login attempts;

We actively monitor for the behaviors above and reserve the right to log relevant technical information (IP address, request patterns, timestamps) and to block or restrict access, as described in Section 14 and in our Privacy Policy.

6. Your Submissions

When you submit information through a Site form (contact inquiry, service request, job application, resume, or similar), you confirm that the information is accurate and that you have the right to submit it. You grant us a non-exclusive, royalty-free license to use that information for the purposes described in our Privacy Policy — principally, to respond to you and evaluate any resulting business or employment relationship. Do not submit anyone else's personal information without their consent.

7. Service Engagements

Descriptions of our marketing, CRM, and development services on the Site are illustrative and do not themselves create a client relationship or service agreement. Any actual engagement for paid services (scope, deliverables, timelines, fees, and payment terms) is governed exclusively by a separate written proposal, statement of work, or service agreement signed by both parties, which will take precedence over these Terms for that engagement. For project-based engagements, our standard payment milestones and cancellation/refund terms are set out in our Refund Policy.

8. Intellectual Property

All content on the Site — including text, graphics, logos, the Webspecia® name and mark, case-study results, and site design — is owned by Cognidom Technologies Private Limited or its licensors and is protected by applicable intellectual property laws. You may view and share Site content for personal, non-commercial reference, but you may not reproduce, modify, distribute, or create derivative works from it without our prior written consent.

9. Third-Party Links & Services

The Site may link to, or embed content from, third-party websites and services (e.g. WhatsApp, YouTube, Wistia, our social media profiles, and our app-store listings). We do not control and are not responsible for the content, policies, or practices of any third-party service. Your use of those services is subject to their own terms.

10. Privacy

Our collection and use of personal information in connection with the Site is described in our Privacy Policy, which forms part of these Terms.

11. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT RESULTS DESCRIBED IN ANY CASE STUDY OR TESTIMONIAL WILL BE REPLICATED FOR YOU.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COGNIDOM TECHNOLOGIES PRIVATE LIMITED AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED, AND DOES NOT APPLY TO A SEPARATE SIGNED SERVICE AGREEMENT, WHICH GOVERNS LIABILITY FOR PAID ENGAGEMENTS.

13. Indemnification

You agree to indemnify and hold Webspecia and Cognidom Technologies Private Limited harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

14. Access Restriction & Termination

We may restrict, suspend, or block your access to the Site (including by IP address or address range) at any time, without notice, if we reasonably believe you have violated these Terms, engaged in abusive or fraudulent behavior, or posed a security risk — consistent with the monitoring described in our Privacy Policy. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to applicable law, you agree that any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the competent courts at Delhi, India.

16. Changes to These Terms

We may update these Terms from time to time. We will update the "Effective date" above when we do. Continued use of the Site after an update constitutes acceptance of the revised Terms.
